Litigation can be stressful, expensive and slow. Our goal is to find the quickest, least expensive method toward an acceptable and equitable resolution to your legal problem.
After taking the necessary steps to understand your problem, and the strengths and weaknesses of your case, we will attempt to negotiate, conciliate or mediate a satisfactory resolution. Matters can often be resolved and brought to a conclusion in this fashion.
If, however, these methods are unsuccessful, then our litigation department can and will proceed to resolve issues through the Courts. Our litigation department has extensive experience, having successfully tried a wide range of matters, including: contested estates, corporate and family disputes, and the full range of general litigation matters.
Mortgage Enforcement – Power of Sale and Foreclosures
A mortgage is a promise to pay, registered against the title of the property. If a mortgage goes into default, the creditor can get paid by, among other things, forcing the sale of the property though a “Power of Sale”. If and when judgement is obtained, the creditor can take possession of the property, and put it up for sale. If the sale of the property does not fully satisfy the amount of the debt, the creditor can still come to the debtor to satisfy the remaining debt.
We can assist you with each stage of the Power of Sale process, from serving the initial Notice of Sale Under Charge, to filing the Statement of Claim with the Court, to obtaining judgment and enforcing possession and the ultimate sale of the property.
